Digital cheque presentment is now recognised by law; an appellate judgment clarifies a narrow citizenship-by-registration rule.
1. Digital cheque presentment — enacted laws. Laws 142(I)/2026 and 143(I)/2026 were published on 30 October 2026 and state no later commencement date. A cheque may now be presented through a faithful, clear digital image of both sides using the presenting bank’s systems, but only where that bank accepts digital presentment; the image then has the same effect as presentation of the original.
For a digitally presented cheque that is not paid, the presenting credit institution may record electronically the reason for non-payment and presentation date. That record is admissible in court and creates a rebuttable presumption. Businesses and individuals using cheques should confirm their bank’s procedure, retain the original and preserve the bank’s digital record, especially where recovery proceedings may follow.
2. Citizenship by registration — appellate judgment. In Allouzi v Republic, delivered on 15 October 2026 and officially announced on 27 October, the Administrative Court of Appeal interpreted the fourth proviso to section 110(2) of the Civil Registry Law. It held that a person who acquired Cyprus citizenship by registration cannot pass a registration entitlement to a later foreign spouse. This is an interpretation of existing law, effective from delivery, not new legislation.
The ruling is confined to this registration route and does not decide other citizenship or naturalisation routes. Affected spouses and advisers should establish how the Cypriot spouse acquired citizenship, identify the legally available route before filing and avoid relying on marriage alone as creating an entitlement.
